How Long Do I Have to File a Personal Injury Claim in New York?

The time to file a personal injury claim, known as the statute of limitations, is dictated by the type of claim your are bringing. For instance, most medical malpractice cases must be brought within two and one-half years from the date of malpractice, although that time period can be extended for infants or in the case of continuous treatment by the negligent medical provider. If you wish to pursue a negligence claim for things such as a motor vehicle accident or work place injury, there is a three-year time limit from the date of the accident or injury to pursue a legal action. Wrongful death claims, in most instances, have a two-year statute of limitations. Additionally, if your claim is against a public entity or employee, you must file a written Notice of Claim within 90 days of the accident.
